South star Dhanush gets relief from Supreme Court, petition against smoking poster canceled

For the last few months, a very close watch has been kept on the stars who promote smoking and gutkha. Last year, summons were sent to many Bollywood stars in this case. Names of big stars like Akshay Kumar, Ajay Devgan and Shahrukh Khan were included in this list. Now the names of South Stars also seem to be involved in this matter. However, in the meantime, relief news has come for South superstar Dhanush.

Actually, a petition was filed against the posters of Dhanush’s Tamil film Velaiilla Pattathari, released in 2014. Now, while giving its verdict in this matter on January 16, the Supreme Court refused to interfere with the order of the Madras High Court. The Madras High Court had already quashed the criminal proceedings against the posters of Velaiilla Pattathari in its hearing.

Talking about the poster, Dhanush was seen smoking a cigarette. Through a personal complaint, the actor was accused of promoting the use of cigarettes in his films. In its hearing, the bench said that after seeing and understanding AIDS, it was of the view that sub-section (1) of Section 5 of the Cigarettes and Other Tobacco Products Act, 2003 was not applicable in this case. Therefore this petition is dismissed.

The complainant alleges that this was a crime under the Cigarettes and Other Tobacco Products Act, 2003. Not only this, in this case the Madras High Court says that the court cannot be influenced by emotions and popular beliefs. The court will have to strictly understand the provisions and come to the conclusion whether the facts in this case constitute a crime or not.
